Exploring How IEPs Impact the Engineering World: A Legal Perspective

Modern world is ruled by the desire of each customer to receive exactly what he expects, when he expects it and as soon as possible. A product as complex as a Smart Car (for instance) can be customized and adapted to the needs and demands of a wide clientele, and this is possible due to the precision work performed by the engineers and production staff and the specific machined parts manufactured by several subcontractors, which perfectly work together to provide the final client with all its requirements. It is in this context that SC FABRICA DE BUCȘE SRL affiliates its production and manufacturing process – customized, precise, agile and complete. And exactly this is also the concept behind the design and application of an IEP. By definition, but also by purpose, the IEP serves as a formal legal document. It is indeed a complex document, with specific clauses, with rights and obligations on both parties, with strict deadlines and multiple obligations, formalities and stipulations, and one of its most important features is that it must be completely compliant with the law, which makes it a legal-document. The most obvious function of the IEP is that it supports the specific development of a child – that is true. However, the idea behind the IEP is also to create a set of obligations for the school officials, just like in a contract or a legal-document, to contribute to the process of building the occupied environment in which the student will be able to thrive towards achieving his full potential. And one of those obligations is that of creating the necessary environment in which the child will properly communicate, from an emotional, sensorial and verbal perspective. Then, it is specifically stated by the educational law and system, that the IEP is a legal-document; in general terms, a legal-document is only a manifestation of intentions which formally and legally binds the interested parties. The similarity between an individual education program and a contract (or any other type of legal-document [“ce este un iep? / iep-ul este un document legal si nu o simpla lista de activitati de invatare, care atesta ca parintele este de acord cu cei stabilite in cadrul echipei i.e.p.]) is so obvious, that it allows us to state that the mechanism which is used to customize an IEP for the specific needs of a child, can be compared to the method which SC FABRICA DE BUCȘE SRL uses to prepare, in a customized, precise and agile manner, the mechanical elements which will together contribute to the end producto (the IEP). The way in which an IEP is customized resembles, very much, the manner in which SC FABRICA DE BUCȘE SRL manipulates its resources (its staff and subcontractors) in order to build the appropriate engineering solution for the client’s request. And, just like in the mechanical field, the quality assurance of the legal-document depends (almost completely) on the performance and involvement of each person which participates to the process (starting from the drafting phase, to corrections, to signing and to implementation). Just like in the case of SC FABRICA DE BUCȘE SRL, also in the case of an IEP, any job must undergo a quality check-up system which will ensure that both the ends (the purpose of each sub-contracting and the quotas established by the external partner) are achieved and the functional integrity and compliance for the legal-document is maintained.
